General terms of use and sale

These terms govern the use of Embaucheo (the "Service") and the subscription to the premium offering. By using the Service, you accept them. They are governed by Swiss law.
1. Purpose and acceptance
These terms form the contract between you and the publisher of Embaucheo. Acceptance takes place upon the creation of an account or the use of the Service.
2. Description of the Service
The Service is a CV builder and job-application assistant. It offers:
- a free offering: creation, editing and PDF export of CVs, without a watermark;
- a premium offering (paid): advanced AI features and additional tools.
Some features are modules that the publisher may enable or disable.
3. Account and anonymous users
Creating a CV is possible without an account (a draft linked to your browser). Logging in is done without a password, via a magic link sent by e-mail. On login, an anonymous draft is attached to your account.
4. Acceptable use
You undertake to make personal and lawful use of the Service, not to disrupt it, not to publish unlawful content on it, and to provide accurate information about yourself.
5. Prices and payment
The prices of the premium offering are stated in Swiss francs (CHF), all taxes included. [À COMPLÉTER : prix exact et périodicité, p. ex. CHF X.–/mois ou CHF X.–/an]. Payment is processed by our provider [À COMPLÉTER : prestataire de paiement]. In the event of late payment, art. 102 et seq. CO apply.
6. Subscription, renewal and termination
The premium subscription is taken out for a period (monthly or annual) and renews automatically for an identical period, unless renewal is disabled. You may disable automatic renewal at any time, by a process as simple as subscribing (art. 8 UCA): [À COMPLÉTER : décrire le parcours, p. ex. un bouton « Désactiver le renouvellement » dans le compte]. The subscription then ends at the expiry of the current period. The period already started is not refunded (see point 8).
7. Right of withdrawal
In Switzerland, the law does not provide for a right of withdrawal for digital services ordered online (art. 40a et seq. CO do not cover electronic commerce). The premium offering is a service with immediate performance.
The right of withdrawal applicable to consumers in the EU / France is described in point 16.
8. Refund
The subscribed period (month or year) is non-refundable once access to the service has been opened: it is a digital service with immediate performance, for which you expressly requested immediate performance and waived your right of withdrawal (see points 7 and 16). Disabling automatic renewal is possible at any time and prevents the charge for the following period, but does not give rise to a refund of the current period. Only billing errors are corrected.
9. AI assistant - no guarantee of results
The AI features provide assistance (suggestions, analyses). They guarantee neither the obtaining of a job nor the accuracy of the generated content. You are responsible for the proofreading and final validation of your CV and your applications. The processing by the AI sub-processor is described in the privacy policy.
10. Your content and intellectual property
You remain the owner of the content and CVs you create. You grant the publisher a limited licence, strictly necessary for the provision of the Service (storage, display, PDF generation). The publisher retains all rights to the Service, its templates and its trademark.
11. Availability
The Service is provided without any guarantee of continuous availability. Interruptions (maintenance, incidents) may occur.
12. Warranty and liability
To the extent permitted by Swiss law, the publisher excludes any warranty beyond what the law provides (art. 197 et seq. CO). Liability for gross negligence or wilful misconduct cannot be excluded (art. 100 para. 1 CO). Otherwise, the publisher's liability is limited to the amount you have paid over the last 12 months.
13. Termination by the publisher
The publisher may suspend or close an account in the event of a breach of these terms or of abusive use.
14. Amendment of the terms and prices
The publisher may amend these terms and its prices. Changes are announced [À COMPLÉTER : préavis, p. ex. 30 jours] and published on this page. Your continued use constitutes acceptance.
15. Applicable law and jurisdiction
These terms are governed by Swiss law, excluding its conflict-of-laws rules. The place of jurisdiction is [À COMPLÉTER : ville / canton du siège], subject to mandatory places of jurisdiction, in particular the place of jurisdiction at the consumer's domicile (art. 32/35 CPC).
16. Consumers in the European Union / France
If you are a consumer residing in the EU / France, you have a 14-day right of withdrawal from the time of subscription (Directive 2011/83/EU). However, by requesting immediate access to the service and expressly consenting to it, you waive this right once the service has been performed (e.g. from the first export or the first premium AI action). The mandatory consumer-protective places of jurisdiction of your country of residence remain reserved.
